This guidance handbook supports member states of the Common Market for Eastern and Southern Africa (COMESA) in domesticating the revised Common Investment Area (CCIA) Agreement, adopted in July 2026. It sets out practical legal, policy, and institutional actions for aligning national frameworks with the CCIA, helping attract and govern sustainable investment across the region.

Investment governance across COMESA is at a pivotal moment. The revised Investment Agreement establishing the COMESA CCIA, adopted by the Council of Ministers of Industry in July 2026, offers a modernized, balanced framework to attract and retain sustainable investment while preserving member states' right to regulate in the public interest. The critical variable, however, is implementation: the CCIA will deliver its intended outcomes only if member states translate treaty commitments into coherent national legal, institutional, and administrative practice.
The handbook offers member states a structured, practical menu of legal, policy, and institutional actions linked to each part of the CCIA, organized along two reinforcing tracks—legal and policy reform, and institutional and administrative modernization. It is guided by core principles such as functional alignment over verbatim transposition and vertical coherence with continental frameworks, like the African Continental Free Trade Area Protocol on Investment, and it recognizes that sequencing belongs to governments: there is no single implementation template, and each member state adapts and prioritizes actions according to its own legal tradition, capacity, and priorities.
These principles translate into a five-step national roadmap—assess, diagnose gaps, reform, coordinate, and monitor and learn—that each member state can sequence to its own circumstances. As a practical first step, the handbook also proposes a pilot program to test and refine the alignment process, laying the groundwork for a scalable, regionally coherent approach to modernizing investment frameworks across COMESA.
