Surge in Sanctions-Related Arbitration Claims Targeting Ukraine and Its Allies

A new civil society report emphasizes that the surge in sanctions-related investor-state dispute settlement (ISDS) claims has accelerated dramatically. At least 28 cases have been initiated or threatened by sanctioned Russian oligarchs or companies claiming total damages of approximately USD 62 billion. More than half of the cases challenging sanctions were filed in 2025 alone. Notably, Ukraine itself continues to face ISDS claims from Russian or Russia-linked entities, with seven cases brought under BITs with EU member states and two additional cases under the Ukraine-UK investment treaty.
