Regional Comprehensive Economic Partnership Discussions on ISDS Inclusion
Although the Regional Comprehensive Economic Partnership (RCEP) does not include ISDS in its investment chapter, its member states are actively debating whether to include ISDS within the bloc’s legal framework. While some countries favour ISDS provisions to protect cross-border investors, others, including New Zealand, have expressed caution due to concerns over regulatory chill, among other factors. The discussions come as RCEP consolidates its role as the largest free trade agreement in the Asia-Pacific, covering nearly one-third of global GDP.
