UNIDROIT and ICC Open Public Consultation on Draft Instrument for International Investment Contracts
On June 24, 2026, UNIDROIT and the ICC Institute of World Business Law launched a 12-week public consultation, open until September 15, 2026, on the draft Principles and Model Clauses for International Investment Contracts, prepared by their joint Working Group over eight sessions between October 2023 and January 2026. Building on the UNIDROIT Principles of International Commercial Contracts, the draft attempts to address contractual investor protections alongside sustainability-related obligations at the contract level. This is the first time the text has been exposed to stakeholders beyond the Working Group. IISD has published a brief urging governments, civil society, project-affected communities, and academics, particularly from developing and emerging economies, to engage in the consultation and anchor sustainable development in the final text. With investment protection increasingly shifting from treaties to contracts, the instrument could shape negotiating practice for a generation, making broad participation in this window essential.
