CRiSTAL Stories: CRiSTAL Supports Climate-Resilient Development in the Peruvian Andes

In this CRiSTAL Stories brief, Marius Keller and Tatiana Farfán de la Vega document how the application of the Community-Based Risk Screening Tool - Adaptation and Livelihoods (CRiSTAL) framework in the municipality of Santa Teresa, in the Cusco region of Peru.

This led to identification by the local communities of a range of climate and gender-sensitive adaptation measures, in line with their local culture and traditions. Continuous engagement of local government in the CRiSTAL process further contributed to the inclusion of climate adaptation into local development plans, which is now being replicated in the surrounding municipalities.

CRiSTAL Stories: CRiSTAL helps farmers adapt to drought on the slopes of Mount Elgon, Uganda

In this CRiSTAL Stories brief, Julie Karami-Dekens and Sophie Kutegeka document how the application of the Community-Based Risk Screening Tool - Adaptation and Livelihoods (CRiSTAL) framework in Sansaza parish, Eastern Uganda.

This led to the development of a community-driven water gravity flow scheme for irrigation to help people adapt to prolonged dry spells—a trend that may increase in the context of climate change. Other outcomes of the CRiSTAL process include: the development of a common understanding of climate issues, increased cohesion among local actors, and increased support for climate adaptation in the area from external agencies.

EcoHealth: Health, Well-Being and Watersheds

This brochure summarizes the watershed-based approach to ecohealth taken by the International Institute for Sustainable Development, in partnership with the Network for Ecosystem Sustainability and Health.

It provides the rationale for approaching public health at the watershed level and illustrates how the ecohealth concept can be applied through case studies on the Cowichan Watershed in British Columbia and the Seine Watershed in Manitoba.Ecohealth thinking can improve the efficiency of health care investments by proactively protecting people from threats and improving their day-to-day surroundings and sense of security. Preventive public health through watershed management may, in fact, be a more efficient allocation of scarce resources than standard health spending.

This paper looks at the criteria defining the range of protection granted to investors, and particularly at the role the nationality of an investor can play in investor-state arbitration.

It also analyzes the issues that may arise in this regard, by taking into account the respective bilateral investment treaty (BIT) clauses and the interpretation provided by the international arbitration tribunals. In addition, the paper gives a set of recommendations regarding how to address issues such as dual nationality, and how to provide clear and predictable definitions when drafting the BIT chapters and clauses on investor protection.

This paper focuses on the definition of indirect expropriation in international investment law and aims to identify a set of criteria to overcome the existing issue of consistency and foreseeability while helping to provide a clear definition of the concept of indirect expropriation.

It also looks at current practice in recent investment treaties and the criteria for identifying an indirect expropriation as derived from tribunal case law. Finally, the paper presents possible solutions to address the existing issues, through redrafting of clauses following some best practices in recent investment treaties, and the possibility of tribunals adapting their case law to the current challenges.
