{"id":9250,"date":"2023-07-01T08:44:58","date_gmt":"2023-07-01T06:44:58","guid":{"rendered":"https:\/\/cf.iisd.net\/itn\/?p=9250"},"modified":"2024-08-09T18:33:01","modified_gmt":"2024-08-09T16:33:01","slug":"norway-terminates-its-iias-with-european-economic-area-members","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2023\/07\/01\/norway-terminates-its-iias-with-european-economic-area-members\/","title":{"rendered":"Norway terminates its IIAs with European Economic Area members"},"content":{"rendered":"<p>The Government of Norway has been pursuing the termination of its bilateral investment treaties (BITs) with members of the European Economic Area (EEA\u2013EEA membership contains <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> and European Free Trade Association members).<\/p>\n<p>In a <a href=\"https:\/\/www.regjeringen.no\/no\/tema\/naringsliv\/handel\/nfd---innsiktsartikler\/frihandelsavtaler\/investeringsavtaler\/id438845\/\">statement on its website<\/a>, the Norwegian Ministry of Trade, Industry and Fisheries confirmed that:<\/p>\n<p>\u201cThe majority of EU countries have concluded a plurilateral agreement on the termination of bilateral investment protection agreements (BITs) between EU countries. Based on this decision, Norway has conducted its own assessment of Norway\u2019s BITs with other EEA countries and concluded that the agreements should be terminated. We have initiated negotiations on termination agreements with the countries in question, and the negotiations are at various stages. The termination agreements with Estonia, Latvia, Lithuania, Romania, and Hungary have now entered into force. This means, among other things, that the bilateral investment protection agreements with these countries can no longer be used as a basis for investor\u2013state dispute settlement.\u201d [unofficial translation]\n<p>According to the available termination texts and official communications, all the termination agreements include a clause to terminate IIAs\u2019 sunset clauses at the date of the entry into force of the termination agreement.
