{"id":9128,"date":"2022-12-26T08:46:42","date_gmt":"2022-12-26T07:46:42","guid":{"rendered":"https:\/\/cf.iisd.net\/itn\/?p=9128"},"modified":"2024-08-09T18:32:40","modified_gmt":"2024-08-09T16:32:40","slug":"irish-supreme-court-weighs-in-on-ceta-constitutionality","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2022\/12\/26\/irish-supreme-court-weighs-in-on-ceta-constitutionality\/","title":{"rendered":"Irish Supreme Court weighs in on CETA constitutionality"},"content":{"rendered":"<p>On November 11, 2022, the Irish Supreme Court handed down <a href=\"https:\/\/www.courts.ie\/view\/judgments\/d9589327-898e-4d2d-a2f3-1cc17f7105a6\/bc918f1c-9730-4c69-acde-a76d256e37b5\/2022_IESC_44_(Baker%20J).pdf\/pdf\">an important judgment<\/a> regarding the constitutionality of the investment chapter in the <span class='tooltipsall tooltipsincontent classtoolTips41'>CETA<\/span>. The court held that currently, the Irish Constitution precludes the Irish Government from ratifying the CETA. In particular, the court held that the CETA\u2019s <span class='tooltipsall tooltipsincontent classtoolTips43'>ISDS<\/span> provisions would violate Ireland\u2019s judicial and legislative sovereignty and the democratic nature of the state because the CETA permits, among other things, the CETA joint committee to interpret\u2014and therefore amend\u2014the CETA without democratic oversight.
