{"id":9041,"date":"2022-10-07T20:56:55","date_gmt":"2022-10-07T18:56:55","guid":{"rendered":"https:\/\/cf.iisd.net\/itn\/?p=9041"},"modified":"2024-08-09T18:32:33","modified_gmt":"2024-08-09T16:32:33","slug":"debate-over-ects-future-grows-as-november-vote-approaches","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2022\/10\/07\/debate-over-ects-future-grows-as-november-vote-approaches\/","title":{"rendered":"Debate over ECT\u2019s future grows as November vote approaches"},"content":{"rendered":"<p>Ahead of a critical vote this November, the fate of the <span class='tooltipsall tooltipsincontent classtoolTips67'>ECT<\/span> modernization hangs in the balance amid continued questions over whether the reforms go far enough to render the agreement compatible with global climate action goals under the UN\u2019s Paris Agreement.<\/p>\n<p>While the ECT\u2019s contracting parties <a href=\"https:\/\/www.iisd.org\/itn\/en\/2022\/06\/30\/key-questions-remain-as-governments-announce-agreement-in-principle-for-modernized-energy-charter-treaty\/\">struck an agreement in principle<\/a> on reforms to modernize the treaty in June, the text of that agreement did not become public until September, when it was published by <a href=\"https:\/\/pro.politico.eu\/news\/full-text-of-energy-charter-treaty-reform\">POLITICO Pro<\/a>. The newly released text confirms the earlier details that the Energy Charter Conference had announced in June in a brief <a href=\"https:\/\/www.energycharter.org\/fileadmin\/DocumentsMedia\/CCDECS\/2022\/CCDEC202210.pdf\">public communication<\/a>. The text also clarifies other aspects of the modernization reforms that had not previously been known, such as the removal of the current treaty\u2019s non-derogation clause.<\/p>\n<p>However, the text <a href=\"https:\/\/www.iisd.org\/articles\/statement\/newly-released-text-modernized-energy-charter-treaty\">leaves unclear<\/a> other key elements that would affect the treaty\u2019s climate impact. For instance, while the <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> and the United Kingdom have moved to carve out some fossil fuel investments from being protected under the modernized ECT, when those carve-outs would enter into force is not yet known. Also uncertain at this stage is whether those contracting parties that are present and voting will unanimously adopt the modernized ECT when the Energy Charter Conference convenes on November 22, as is required by the treaty\u2019s voting rules.<\/p>\n<p>Some EU member states have already signalled their discomfort with the modernized ECT. For example, Spain\u2019s Deputy Prime Minister Teresa Ribera <a href=\"https:\/\/www.politico.eu\/article\/spain-demands-eu-leave-energy-treaty-over-climate-concerns\/\">told POLITICO<\/a> in June that the EU and its member states should move to leave the existing treaty, rather than signing onto the reforms.<\/p>\n<p>\u201cAt a time when accelerating a clean energy transition has become more urgent than ever, it is time that the EU and its member states initiate a coordinated withdrawal from the ECT,\u201d Ribera told the news outlet at the time. Along with being one of Spain\u2019s deputy prime ministers, Ribera also serves as the government\u2019s minister for ecological transition.<\/p>\n<p>Separately, a draft law is under consideration in Poland to unilaterally withdraw from the current ECT, which <a href=\"https:\/\/www.euractiv.com\/section\/energy\/news\/poland-drafts-law-to-terminate-controversial-energy-charter-treaty\/\">cites among other reasons<\/a> concerns about the treaty\u2019s investor\u2013state dispute settlement mechanism and the expectation that the modernization would not rectify that aspect. France is among the other ECT contracting parties to have floated <a href=\"https:\/\/www.euractiv.com\/section\/energy\/news\/france-puts-eu-withdrawal-from-energy-charter-treaty-on-the-table\/\">withdrawal as an option<\/a> in the past, depending on the outcomes of the modernization.<\/p>\n<p>The treaty also continues to draw harsh criticism from international advocates for environmental action, who note the long history of fossil fuel investors using the ECT to challenge governments\u2019 climate mitigation measures. Ian Fry, the United Nations Special Rapporteur on the promotion and protection of human rights in the context of climate change, named the \u201crepeal of the Energy Charter Treaty\u201d as one of the moves that could help in \u201cbridging the climate mitigation gap\u201d in a <a href=\"https:\/\/undocs.org\/Home\/Mobile?FinalSymbol=A%2F77%2F226&amp;Language=E&amp;DeviceType=Desktop&amp;LangRequested=False\">new report<\/a> sent to the UN General Assembly.<\/p>\n<p>The upcoming Energy Charter Conference vote will come on the heels of the United Nations Framework Convention on Climate Change\u2019s Twenty-Seventh Conference of the Parties (COP 27) in Sharm El-Sheikh, Egypt, scheduled for November 6 to 18.
