{"id":8217,"date":"2020-12-19T07:40:10","date_gmt":"2020-12-19T13:40:10","guid":{"rendered":"https:\/\/cf.iisd.net\/itn\/?p=8217"},"modified":"2024-08-09T18:31:27","modified_gmt":"2024-08-09T16:31:27","slug":"asia-pacific-leaders-sign-rcep","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2020\/12\/19\/asia-pacific-leaders-sign-rcep\/","title":{"rendered":"Asia-Pacific leaders sign RCEP"},"content":{"rendered":"<p>On November 15, 2020, 15 Asia-Pacific countries signed the <a href=\"https:\/\/www.iisd.org\/itn\/tag\/rcep\/\">Regional Comprehensive Economic Partnership<\/a> (<span class='tooltipsall tooltipsincontent classtoolTips35'>RCEP<\/span>) nearly one year after negotiations came to a close.<\/p>\n<p>The signatories include the 10 members of the Association of Southeast Asian Nations (<span class='tooltipsall tooltipsincontent classtoolTips15'>ASEAN<\/span>) and their six <span class='tooltipsall tooltipsincontent classtoolTips70'>FTA<\/span> partners, Australia, China, India, Japan, New Zealand, and South Korea. India withdrew from negotiations in 2019, <a href=\"https:\/\/indianexpress.com\/article\/explained\/india-out-of-rcep-china-economy-trade-angle-7053877\/\">reportedly citing<\/a> its desire to safeguard domestic industries.<\/p>\n<p><a href=\"https:\/\/rcepsec.org\/wp-content\/uploads\/2020\/11\/Chapter-10.pdf\">Chapter 10<\/a> of the agreement covers investment, and includes standard definitions of investor and investment (though excluding government procurement), and substantive investment provisions.\u00a0 The chapter also includes sections on investment promotion and facilitation, including, in Article 10.17.1(d), the commitment to establish or maintain \u201ccontact points, one-stop investment centres, focal points or other entities \u2026 to provide assistance and advisory services to investors,\u201d and, where appropriate, to amicably settle disputes between investors and state entities.<\/p>\n<p>Notably, the agreement does not include <span class='tooltipsall tooltipsincontent classtoolTips43'>ISDS<\/span> at this time. However, Article 10.18 lays out a process for the parties to enter into discussions on whether to include ISDS, and apply the treaty\u2019s prohibition of expropriation to taxation measures. These talks should take place in the next two years.
