Though the UK has formally left the European Union, EU law continues to apply to the UK during the transition period, which ends on December 31, 2020.<\/p>\n<p>The <a href=\"https:\/\/cf.iisd.net\/itn\/2019\/04\/23\/achmea-judgement-fallout-22-eu-member-states-agree-to-terminate-intra-eu-bits\/\">decision<\/a> to terminate intra-EU BITs was reached in October 2019, and 23 member states \u2013 excluding Austria, Sweden, Ireland, Finland, and the UK\u2014formally agreed to do so on May 5, 2020. This agreement, which entered into force on August 29, 2020, <a href=\"https:\/\/cf.iisd.net\/itn\/2020\/06\/20\/eu-member-states-sign-agreement-to-terminate-intra-eu-bits-while-german-investor-brings-claim-against-the-netherlands-under-the-ect\/\">outlined<\/a> the steps members states must take both to terminate their BITs and to address ongoing arbitration proceedings.<\/p>\n<p>Despite the May 2020 agreement, reaching a consensus among the member states with regard to intra-EU BITs has been slow going. While Ireland and Italy terminated their BITs with other member states early in the last decade, other states\u2014namely Austria, Romania, and Sweden\u2014have already faced<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/IP_15_5198\"> infringement proceedings<\/a> for failing to terminate their treaties. Romania subsequently did begin termination in 2017, while Austria and Sweden have <a href=\"https:\/\/www.nortonrosefulbright.com\/en\/knowledge\/publications\/de736178\/sun-to-set-on-intra-eu-bilateral-investment-treaties\">reportedly<\/a> recently begun terminating their BITs bilaterally.<\/p>\n<p>According to the May <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/EN\/INF_20_859\">infringements package<\/a> released by the EC, Finland and the UK have \u201cfailed to engage in any discussion with the member states\u201d regarding the bilateral termination of their BITs. In the case of infringement proceedings, member states are required to respond with a detailed reply within two months.
