{"id":8012,"date":"2020-07-14T12:19:03","date_gmt":"2020-07-14T17:19:03","guid":{"rendered":"http:\/\/iisd.org\/itn\/?p=8012"},"modified":"2024-08-09T18:31:05","modified_gmt":"2024-08-09T16:31:05","slug":"ec-launches-consultation-on-facilitating-intra-eu-investment","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2020\/07\/14\/ec-launches-consultation-on-facilitating-intra-eu-investment\/","title":{"rendered":"EC launches consultation on facilitating intra-EU investment"},"content":{"rendered":"<p>On May 26 2020, the <span class='tooltipsall tooltipsincontent classtoolTips116'>EC<\/span> launched a <a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12403-Investment-protection-and-facilitation-framework\/public-consultation\">consultation<\/a> to clarify and supplement rules on cross-border investment within the <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span>.<\/p>\n<p>According to the <a href=\"https:\/\/ec.europa.eu\/info\/sites\/info\/files\/business_economy_euro\/banking_and_finance\/documents\/2020-investment-protection-consultation-document_en.pdf\">consultation document<\/a> released by the EC, the EU currently faces a growing need for private investment \u2013 both for its efforts to mitigate climate change and remain competitive in an increasing digital economy \u2013  while inward investment levels have declined. While the document notes that investment into the EU has decreased and intra-EU investment has not increased, the consultation focuses only on the facilitation of the latter.<\/p>\n<p>The EC notes that the situation can be partly attributed to a lack of investor confidence in the wake of the <a href=\"https:\/\/cf.iisd.net\/itn\/2019\/04\/23\/achmea-judgement-fallout-22-eu-member-states-agree-to-terminate-intra-eu-bits\/\">Achmea decision<\/a>, which led to the termination of intra-EU BITs. The document cites investor concerns related to a lack of policy stability, and the potential to be at a disadvantage compared to non-EU investors who can still rely on the protection of BITs. The EC states, however, that EU law still provides investors with full protection.
