{"id":7919,"date":"2020-06-20T08:46:34","date_gmt":"2020-06-20T13:46:34","guid":{"rendered":"http:\/\/www.iisd.org\/itn\/?p=7919"},"modified":"2024-08-09T18:31:01","modified_gmt":"2024-08-09T16:31:01","slug":"european-commission-releases-guidance-for-fdi-screening-in-response-to-global-pandemic","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2020\/06\/20\/european-commission-releases-guidance-for-fdi-screening-in-response-to-global-pandemic\/","title":{"rendered":"European Commission Releases Guidance for FDI Screening in Response to Global Pandemic"},"content":{"rendered":"<p>On March 25, 2020, the European Commission published a <a href=\"https:\/\/trade.ec.europa.eu\/doclib\/docs\/2020\/march\/tradoc_158676.pdf\">guidance<\/a> for member states on <span class='tooltipsall tooltipsincontent classtoolTips68'>FDI<\/span> screening in the face of the COVID-19 pandemic, focusing on, but not limited to, health-related industries.<\/p>\n<p>The new guidance comes a <a href=\"https:\/\/www.iisd.org\/itn\/2019\/04\/23\/new-eu-framework-on-foreign-investment-screening-to-take-effect-in-april\/\">year<\/a> after the release of the <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span>\u2019s new framework for screening FDI, which is set to come into force in October 2020. The 2019 framework allows member states to block or place restrictions on investment transactions that are deemed to pose a threat to \u201ccritical infrastructure, critical technologies, the supply of critical inputs, such as energy or raw materials, access to sensitive information or the ability to control information, or the freedom or pluralism of the media,\u201d according to a <a href=\"http:\/\/trade.ec.europa.eu\/doclib\/docs\/2019\/february\/tradoc_157683.pdf\">factsheet<\/a> released last year.<\/p>\n<p>According to the Commission, the pandemic has \u201cincreased potential risk to strategic industries, in particular but by no means limited to healthcare-related industries\u201d and urges member states to ensure that the crisis \u201cdoes not result in a sell-off of Europe\u2019s business and industrial actors, including SMEs [small and medium enterprises].\u201d The guidance also identifies the potential danger of \u201cpredatory buying\u201d of strategic assets with \u201ca view to limit supply to the EU market.\u201d<\/p>\n<p>The guidance notes that responsibility rests with member states to make full use of their current FDI-screening mechanisms to \u201ctake fully into account the risks to critical health infrastructure, supply of critical inputs, and other critical sectors as envisaged in the EU legal framework.\u201d At present, 14 member states have currently established FDI-screening mechanisms.
