{"id":7772,"date":"2020-03-10T08:36:07","date_gmt":"2020-03-10T13:36:07","guid":{"rendered":"https:\/\/iisd.org\/itn\/?p=7772"},"modified":"2024-08-09T18:30:45","modified_gmt":"2024-08-09T16:30:45","slug":"eu-parliamentarians-endorse-vietnam-trade-investment-deals","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2020\/03\/10\/eu-parliamentarians-endorse-vietnam-trade-investment-deals\/","title":{"rendered":"EU parliamentarians endorse Vietnam trade, investment deals"},"content":{"rendered":"<p>The European Parliament has given the green light to the 27-nation bloc\u2019s <a href=\"https:\/\/trade.ec.europa.eu\/doclib\/docs\/2016\/june\/tradoc_154622.pdf\">trade and investment agreements<\/a> with Vietnam, over seven years after those negotiations formally began.<\/p>\n<p>The two agreements were initially meant to fall within one single <span class='tooltipsall tooltipsincontent classtoolTips70'>FTA<\/span> that would include investment provisions. The FTA was <a href=\"http:\/\/trade.ec.europa.eu\/doclib\/docs\/2015\/august\/tradoc_153674.pdf\">agreed in principle<\/a> in August 2015 and in full <a href=\"https:\/\/www.iisd.org\/itn\/2016\/02\/29\/standing-tribunal-included-in-european-union-vietnam-fta\/\">later that year<\/a>, though the investment provisions were later separated out from the main FTA text and built into a new Investment Protection Agreement.<\/p>\n<p>While the <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> and <span class='tooltipsall tooltipsincontent classtoolTips15'>ASEAN<\/span> had originally envisioned negotiating a region-to-region agreement, these efforts were put on hold over a decade ago. The EU has since been negotiating agreements with <a href=\"https:\/\/ec.europa.eu\/trade\/policy\/countries-and-regions\/regions\/asean\/\">individual ASEAN member economies<\/a>, which proponents say could later pave the way for reviving and updating the original EU\u2013ASEAN negotiations. Those efforts have largely slowed, however, with the only talks still active being those between the EU and Indonesia, as well as those between the EU and Myanmar on investment protection.<\/p>\n<p>The entry into force of the EU\u2013Vietnam trade agreement is still pending ratification in Vietnam, along with some final procedures on the EU side. The Investment Protection Agreement, which would replace the 21 <a href=\"https:\/\/www.iisd.org\/itn\/tag\/bits\/\">BITs<\/a> that exist between the Southeast Asian country and most of the EU\u2019s member states, will also require the ratification by EU member state and regional legislatures.<\/p>\n<p>The decision to separate out the trade and investment agreements for EU-Vietnam was as a result of the 2017 <span class='tooltipsall tooltipsincontent classtoolTips42'>CJEU<\/span> ruling <a href=\"https:\/\/www.iisd.org\/itn\/2017\/06\/12\/ecj-rules-that-european-union-singapore-fta-requires-ratification-by-eu-member-states\/\">that clarified<\/a>, in the case of the EU\u2013Singapore trade agreement, that certain investment issues fell under the EU\u2019s shared competence with its member states, rather than under the EU\u2019s exclusive competence.
