In the previous session, held in April 2019 in New York, the working group had <u><a href=\"https:\/\/undocs.org\/en\/A\/CN.9\/970\">agreed<\/a><\/u> that in the October session it would develop a project schedule for reforms and \u201cdiscuss, elaborate and develop multiple potential reform options simultaneously,\u201d focusing on two tracks: structural reforms and other types of solutions.<\/p>\r\n<p>The <u><a href=\"https:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.165\">draft agenda<\/a><\/u> for the Vienna session indicates that the working group is expected to continue its consideration of ISDS reform based on notes prepared by the secretariat and on submissions from governments to the UNCITRAL secretariat.<\/p>\r\n<p>Documents prepared by the secretariat include newly published notes on <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp166.pdf\">reform options<\/a><\/u> (also available in <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp166_add1.pdf\">tabular form<\/a><\/u>), the establishment of an <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp168.pdf\">advisory centre<\/a><\/u>, <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp169.pdf\">selection and appointment<\/a><\/u> of adjudicators, and possible solutions regarding <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp_172_21_aug.pdf\">third-party funding<\/a><\/u>, as well as two yet-to-be-published working papers, focusing on a code of conduct and on shareholder claims and reflective loss.<\/p>\r\n<p>Submissions made to the secretariat by the following governments are publicly available: <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.171\">Brazil<\/a><\/u>; <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.163\">Chile, Israel and Japan<\/a><\/u> (joint submission); <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp117c.pdf\">China<\/a><\/u>; <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.173\">Colombia<\/a><\/u>; Costa Rica (submissions <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.164\">I<\/a><\/u> and <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp178_new.pdf\">II<\/a><\/u>); <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp.175_ecuador.pdf\">Ecuador<\/a><\/u>; <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.159\"><span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> and its member states<\/a><\/u> (including an <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.159\/Add.1\">addendum<\/a><\/u>); <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.156\">Indonesia<\/a><\/u>; the <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp179_new.pdf\">Republic of Korea<\/a><\/u>; <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.161\">Morocco<\/a><\/u>; <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/176-e_submission_south_africa.pdf\">South Africa<\/a><\/u>; <u><a href=\"http:\/\/undocs.org\/en\/A\/CN.9\/WG.III\/WP.162\">Thailand<\/a><\/u>; and <u><a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/wp174_new.pdf\">Turkey<\/a><\/u>.<\/p>\r\n<p>Any further submissions made by states\u2014as well as translations of submissions in all six official UN languages\u2014will be published on the <u><a href=\"https:\/\/uncitral.un.org\/en\/working_groups\/3\/investor-state\">working group&#8217;s webpage<\/a><\/u> as they become available.
