{"id":6411,"date":"2019-06-27T08:38:18","date_gmt":"2019-06-27T13:38:18","guid":{"rendered":"https:\/\/www.iisd.org\/itn\/?p=6411"},"modified":"2024-08-09T18:29:58","modified_gmt":"2024-08-09T16:29:58","slug":"mexican-senate-ratifies-usmca","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2019\/06\/27\/mexican-senate-ratifies-usmca\/","title":{"rendered":"Mexican Senate ratifies USMCA"},"content":{"rendered":"<p>The Mexican Senate <a href=\"https:\/\/www.gob.mx\/se\/articulos\/el-senado-de-la-republica-aprueba-el-tratado-mexico-estados-unidos-canada-t-mec?idiom=en\">approved<\/a> the implementing legislation for the United States\u2013Mexico\u2013Canada Agreement (<span class='tooltipsall tooltipsincontent classtoolTips20'>USMCA<\/span>) on June 19, 2019, by an overwhelming majority of 114 votes in favour, with less than a dozen against or abstaining.<\/p>\n<p>The vote came just over a week after Mexican President Andr\u00e9s Manuel L\u00f3pez Obrador announced the extraordinary Senate session for the vote on <u><a href=\"https:\/\/www.iisd.org\/itn\/tag\/nafta\/\">replacing <span class='tooltipsall tooltipsincontent classtoolTips19'>NAFTA<\/span><\/a><\/u> with the USMCA.<\/p>\n<p>The USMCA negotiations <u><a href=\"https:\/\/www.iisd.org\/itn\/2018\/10\/17\/nafta-2-0-finalized-announced-as-usmca-mexico-united-states-agree-to-limit-isds-clause-canada-to-pull-out-of-isds-after-a-three-year-window\/\">wrapped up<\/a><\/u> in September 2018, just over one year after the three countries began formal talks to <u><a href=\"https:\/\/www.iisd.org\/itn\/2017\/09\/26\/canada-mexico-and-united-states-hold-first-and-second-rounds-of-nafta-renegotiation\/\">update NAFTA<\/a><\/u>. The leaders of the three countries involved signed the deal in late November 2018. Among the notable changes to the 1994 NAFTA text was <u><a href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/agreements\/FTA\/USMCA\/Text\/14_Investment.pdf\">the revised <span class='tooltipsall tooltipsincontent classtoolTips43'>ISDS<\/span> language<\/a><\/u>. The changes would <u><a href=\"https:\/\/www.iisd.org\/itn\/2018\/10\/17\/nafta-2-0-finalized-announced-as-usmca-mexico-united-states-agree-to-limit-isds-clause-canada-to-pull-out-of-isds-after-a-three-year-window\/\">limit the application of ISDS<\/a><\/u> only to disputes involving Mexico and the United States and outline which types of claims investors can make under that provision.<\/p>\n<p>The USMCA needs to be ratified by all three signatories, after which three months will need to pass before the agreement\u2019s <u><a href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/agreements\/FTA\/USMCA\/Text\/USMCA_Protocol.pdf\">entry into force<\/a><\/u>. The Mexican process is currently the most advanced.<\/p>\n<p>The office of the Canadian Prime Minister submitted <u><a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/42-1\/bill\/C-100\/first-reading\">Bill C-100<\/a><\/u> to the Canadian House of Commons on May 29, 2019, which would be the implementing legislation for the USMCA in Canada. A first reading was held that day, followed by a second reading on <u><a href=\"https:\/\/www.parl.ca\/LegisInfo\/BillDetails.aspx?Language=E&amp;billId=10511099\">June 11, 2019<\/a><\/u>. The implementing legislation still needs to undergo several further steps, including being approved in both the Canadian House of Commons and Senate, before ratification is complete in that country.<\/p>\n<p>U.S. Vice President Mike Pence <u><a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/remarks-vice-president-pence-prime-minister-trudeau-canada-joint-press-statements-ottawa-canada\/\">said in May<\/a><\/u> that the White House is hoping for Congress to ratify USMCA promptly, ideally completing that process before the end of the summer. The Office of the U.S. Trade Representative (USTR) has already sent a draft statement of administrative action on the USMCA, which Speaker of the House Nancy Pelosi said in late May <u><a href=\"https:\/\/www.speaker.gov\/newsroom\/53019\/\">was premature<\/a><\/u>.<\/p>\n<p>\u201cWe all agree that we must replace NAFTA, but without real enforcement mechanisms we would be locking American workers into another bad deal,\u201d said Pelosi, adding that the Democratic Party, which holds a majority in the House, has \u201cbeen on a path to yes.\u201d Under the <u><a href=\"https:\/\/history.house.gov\/institution\/origins-development\/power-of-the-purse\/\">U.S. Constitution<\/a><\/u>, any legislation that involves the raising of government revenue, including trade agreements, must begin in the U.S. House of Representatives before being voted on in the Senate.<!--more--><\/p>\n<script type=\"text\/javascript\"> toolTips('.classtoolTips19','North American Free Trade Agreement');
