{"id":5990,"date":"2019-04-23T06:52:11","date_gmt":"2019-04-23T11:52:11","guid":{"rendered":"https:\/\/www.iisd.org\/itn\/?p=5990"},"modified":"2024-08-09T18:29:43","modified_gmt":"2024-08-09T16:29:43","slug":"protecting-social-rights-using-the-amicus-curiae-procedure-in-investment-arbitration-a-smokescreen-against-third-parties-maxime-somda","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2019\/04\/23\/protecting-social-rights-using-the-amicus-curiae-procedure-in-investment-arbitration-a-smokescreen-against-third-parties-maxime-somda\/","title":{"rendered":"Protecting Social Rights Using the Amicus Curiae Procedure in Investment Arbitration: A smokescreen against third parties?"},"content":{"rendered":"<p>The participation of a third party in investment arbitration is a relatively recent practice.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> It is based on the fact that investment arbitration involves a state party bound to protect the common interest and usually addresses general measures and questions of public interest. The amicus curiae (friend of the court) is an entity or person not party to the dispute who wishes to present legal arguments before a court or arbitral tribunal.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Although third parties are supposed to simply assist the arbitral tribunal, they often seem to defend causes similar to those defended by one of the parties to the dispute. These causes include internationally recognized social rights, which the facts of the case may threaten.<\/p>\n<p>Amici curiae are admitted under strict conditions in order to protect the equal rights of all parties in the dispute. The admission of amici curiae also lends legitimacy to the investment arbitration process. This calls for an examination of the consideration arbitral tribunals give to the pleadings submitted by amici curiae\u2014in this case, to the arguments relating to social rights. This piece will cover the already problematic question of admission (Section 1) and the issue of the place of social rights in amicus curiae briefs (Section 2) and examine the impact of the arguments (Section 3) for lessons to be drawn (Section 4).<\/p>\n<h2>1. Evolution of the approach to admitting an amicus curiae<\/h2>\n<p>The admission of amici curiae has evolved through the clarification in arbitration rules and investment treaties of the mandate of the arbitrator. Indeed, decisions to refuse amici curiae were based on the consensual nature of arbitration,<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> while decisions to admit them were based on the procedural nature of the amicus curiae,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> the presence of a public interest<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> or the procedure\u2019s legitimizing effect.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>Arbitration rules and investment treaties also established the jurisprudence relating to the conditions of admission.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> They require that petitioners demonstrate their economic independence, the existence of an alternative argument and a general or significant interest, as well as to respect the material context of the dispute and the procedural equality of the parties. Some treaties implicitly reference jurisprudence by citing examples of conditions.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>However, despite being nonprohibitive,<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> these conditions remain restrictive (lack of a right to amicus curiae, limited rights of admitted amici).<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> Moreover, these texts rarely address what consideration should be given to amicus briefs. Some recent treaties specify at most that the tribunal is not required to respond to all arguments<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> or even to discuss any argument at all.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n<h2>2. Place of social rights in amicus curiae briefs<\/h2>\n<p>In defending the rights of populations,<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> amici curiae often rely on arguments related to social rights, in particular the right to water,<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a> the right to health,<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> the right to food<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a> and labour rights.<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a> These rights are sometimes cited in connection with the rights to life, dignity,<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a> a healthy environment, information and consultation,<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a> as well as with public health and the environment.<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a><\/p>\n<p>A variety of texts are cited as providing a legal foundation, including texts concerning human rights and the rights of Indigenous Peoples,<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a> soft law instruments on <span class='tooltipsall tooltipsincontent classtoolTips64'>CSR<\/span><a href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a> and national constitutions.<a href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a><\/p>\n<p>In general, the briefs rarely<a href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a> spend time contesting the tribunal\u2019s authority to rule on the matter. They are often sympathetic to the position of the state because the action under dispute has arisen either from an individual measure terminating an activity that poses a threat to social rights (mining<a href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a> and water service<a href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a> concessions) or from a general measure aimed at protecting the social rights (regulation of harmful products,<a href=\"#_ftn27\" name=\"_ftnref27\">[27]<\/a> agrarian reforms).<a href=\"#_ftn28\" name=\"_ftnref28\">[28]<\/a><\/p>\n<h2>3. Difficulty of presenting effective arguments relating to social rights<\/h2>\n<p>The tribunals\u2019 discretion in considering arguments makes it difficult to identify the criteria that determine an argument\u2019s success or failure. However, even when no references can be found in the award, one can evaluate the effectiveness of an argument by distinguishing between those that support the application of international human rights law in order to assess states\u2019 obligations relating to social rights and those that do not.<\/p>\n<p>Arguments that support the application of international human rights law are never effective, because the tribunals do not accept that a reference to the principles of international law equates to an admission of the applicability of international law universe in the investment treaty.<a href=\"#_ftn29\" name=\"_ftnref29\">[29]<\/a><\/p>\n<p>Likewise, any implication made in the agreement about the applicability of soft law or external standards or the citation of CSR standards<a href=\"#_ftn30\" name=\"_ftnref30\">[30]<\/a> or national law in the investment agreement produces the same results.<\/p>\n<p>In contrast, tribunals seem to accept arguments supporting a specific rule of investment law by way of determining the reasonableness of states\u2019 actions.<a href=\"#_ftn31\" name=\"_ftnref31\">[31]<\/a> Presenting this type of argument is tricky, because it establishes proximity between the arguments of the amici and the tactics of the state, such that the former could support or even make the state\u2019s case.<a href=\"#_ftn32\" name=\"_ftnref32\">[32]<\/a> This proximity can sometimes determine the consideration of amici arguments.<a href=\"#_ftn33\" name=\"_ftnref33\">[33]<\/a><\/p>\n<p>Also included in this category are arguments that require the interpretation of certain standards (for example, <span class='tooltipsall tooltipsincontent classtoolTips69'>FET<\/span>) in a way that is advantageous to the state, even if their relevance is not explicitly analyzed in the tribunal reasoning.<a href=\"#_ftn34\" name=\"_ftnref34\">[34]<\/a><\/p>\n<h2>4. Desirability of demonstrating the existence of a constant protection of social rights<\/h2>\n<p>In the short term, amici should adopt arguments based on investment law. They could demonstrate that the state has acted normally by showing that social rights obligations have been upheld. The reports, recommendations and decisions of human rights bodies could be used to support the argument.<\/p>\n<p>In the long term, states could increase the chance of successfully presenting this type of argument by including investor obligations in the provisions of investment treaties, which would encourage the admission of states\u2019 counterclaims supported by the amici curiae and abet the success of arguments based on applicable law.<\/p>\n<p>Finally, if the identity of the entity presenting the argument is truly significant,<a href=\"#_ftn35\" name=\"_ftnref35\">[35]<\/a> international organizations with an explicit mandate to protect human rights can follow the example of European Commission initiatives<a href=\"#_ftn36\" name=\"_ftnref36\">[36]<\/a> by requiring an amicus curiae brief in any arbitration to which a member state is a party.<\/p>\n<hr \/>\n<h3>Author<\/h3>\n<p><strong>Maxime<\/strong> <strong>Somda Faasseome <\/strong>is a doctoral candidate at the Universit\u00e9 Grenoble Alpes.
