{"id":4818,"date":"2017-12-21T08:44:13","date_gmt":"2017-12-21T14:44:13","guid":{"rendered":"https:\/\/www.iisd.org\/itn\/?p=4818"},"modified":"2024-08-09T18:28:19","modified_gmt":"2024-08-09T16:28:19","slug":"nafta-2-0-canada-mexico-and-u-s-negotiation-rounds-move-into-the-first-quarter-of-2018","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2017\/12\/21\/nafta-2-0-canada-mexico-and-u-s-negotiation-rounds-move-into-the-first-quarter-of-2018\/","title":{"rendered":"NAFTA 2.0: Canada, Mexico and U.S. negotiation rounds move into the first quarter of 2018"},"content":{"rendered":"<p>The three parties to the North American Free Trade Agreement (<span class='tooltipsall tooltipsincontent classtoolTips19'>NAFTA<\/span>) held the third, fourth and fifth rounds of renegotiation (<a href=\"https:\/\/ustr.gov\/about-us\/policy-offices\/press-office\/press-releases\/2017\/september\/trilateral-statement-conclusion-1\">Ottawa, September 23\u201327<\/a>; <a href=\"https:\/\/ustr.gov\/about-us\/policy-offices\/press-office\/press-releases\/2017\/october\/trilateral-statement-conclusion\">Arlington, October 11\u201317<\/a>; and <a href=\"https:\/\/ustr.gov\/about-us\/policy-offices\/press-office\/press-releases\/2017\/november\/trilateral-statement-conclusion\">Mexico City, November 17\u201321<\/a>). The next round of NAFTA renegotiations is <a href=\"https:\/\/ustr.gov\/about-us\/policy-offices\/press-office\/press-releases\/2017\/november\/trilateral-statement-conclusion\">scheduled<\/a> for January 23\u201328, 2018 in Montreal. <a href=\"https:\/\/www.cnbc.com\/2017\/11\/21\/nafta-nations-lock-horns-on-us-auto-demands-as-fifth-round-ends.html\">Negotiations are expected to continue<\/a> through the end of March 2018, before the July 2018 presidential election in Mexico.<\/p>\n<p>On November 17, 2017, the U.S. Trade Representative (USTR) released an <a href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/Press\/Releases\/Nov%20Objectives%20Update.pdf\">updated version<\/a> of the NAFTA negotiating objectives, which were <a href=\"https:\/\/www.iisd.org\/itn\/2017\/09\/26\/canada-mexico-and-united-states-hold-first-and-second-rounds-of-nafta-renegotiation\/\">originally published in July<\/a>. The update expands significantly on the U.S. negotiating objectives with respect to investment.<\/p>\n<p>The updated document clarifies that the objective to \u201creduce or eliminate barriers to U.S. investment in all sectors\u201d includes rules such as national treatment and most-favoured-nation treatment, a minimum standard of treatment under customary international law, and prohibitions on expropriation, transfer restrictions and performance requirements.<\/p>\n<p>Regarding investor\u2013state dispute settlement (<span class='tooltipsall tooltipsincontent classtoolTips43'>ISDS<\/span>), the revised goals aim at ensuring arbitrator impartiality and independence, swift review and dismissal of frivolous claims, and correctness and coherence of the interpretation of investment rules. The USTR also aims at ensuring open hearings, prompt publication of key documents and a mechanism to allow <em>amicus curiae <\/em>submissions.<\/p>\n<p>The United States <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2017-10-14\/u-s-is-said-to-propose-gutting-nafta-legal-dispute-tribunals\">reportedly continues<\/a> to propose an <a href=\"http:\/\/www.foxbusiness.com\/features\/2017\/08\/22\/u-s-bid-to-exit-nafta-arbitration-panels-draws-ire-from-businesses.html\">opt-in system<\/a> for ISDS that would allow each NAFTA country to decide whether or not to participate. On this point, Mexican Economy Minister Ildefonso Guajardo <a href=\"https:\/\/www.reuters.com\/article\/us-trade-nafta-guajardo\/mexico-economy-minister-says-u-s-nafta-autos-proposal-not-viable-idUKKBN1DT38Q\">stated<\/a>: \u201cWe can explore the opt-in, as long as we can define our own opt-in,\u201d and added that, otherwise, Mexico is \u201cnot interested.\u201d<\/p>\n<p>In turn, <a href=\"https:\/\/canadians.org\/blog\/trudeaus-proposed-nafta-chapter-11-reform-not-real-change\">Canada is reported<\/a> to be pushing for the replacement of the Chapter 11 ISDS provision with an Investment Court System (<a href=\"https:\/\/www.iisd.org\/itn\/2015\/11\/26\/investment-court-system-proposed-by-european-commission\/\"><span class='tooltipsall tooltipsincontent classtoolTips72'>ICS<\/span><\/a>), mirroring the one included in the Canada\u2013European Union Comprehensive Economic and Trade Agreement (<a href=\"https:\/\/www.iisd.org\/itn\/2016\/12\/12\/ceta-signed-canada-and-european-union-to-work-expeditiously-on-creating-a-multilateral-investment-court\/\"><span class='tooltipsall tooltipsincontent classtoolTips41'>CETA<\/span><\/a>).
