{"id":3708,"date":"2016-05-16T04:09:49","date_gmt":"2016-05-16T09:09:49","guid":{"rendered":"http:\/\/itn.mattrock.ca\/?p=3708"},"modified":"2024-08-09T18:26:58","modified_gmt":"2024-08-09T16:26:58","slug":"ttip-draft-to-be-prepared-by-july-isds-being-built-based-on-both-eu-and-u-s-proposals","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2016\/05\/16\/ttip-draft-to-be-prepared-by-july-isds-being-built-based-on-both-eu-and-u-s-proposals\/","title":{"rendered":"TTIP draft to be prepared by July; ISDS being built based on both EU and U.S. proposals"},"content":{"rendered":"<p>Officials from the European Union and the United States gathered in Brussels for the 12<sup>th<\/sup>\u00a0round of negotiations over the Transatlantic Trade and Investment Partnership (TTIP) from February 22 to 26.<\/p>\n<p>At the end of the meeting, chief <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> negotiator Ignacio Bercero and chief U.S. negotiator Dan Mullaney\u00a0<a href=\"http:\/\/www.ip-watch.org\/2016\/02\/26\/ttip-negotiations-hurrying-between-official-rounds\/\">announced<\/a>\u00a0that a consolidated draft would be prepared by July 2016, with brackets only for the \u201cmost sensitive issues.\u201d According to Mullaney, finalizing TTIP in 2016 would allow the partners to be \u201cthe standard setters rather than the standard takers\u201d in international trade. Two other negotiating rounds are planned before the summer break. The 13<sup>th<\/sup>\u00a0round took place in New York, from April 25 to 29.<\/p>\n<p>Among the topics discussed in February was the investor\u2013state dispute settlement (<span class='tooltipsall tooltipsincontent classtoolTips43'><span class='tooltipsall tooltipsincontent classtoolTips58'>ISDS<\/span><\/span>) mechanism. Bercero highlighted that the EU is proposing an\u00a0<a href=\"https:\/\/www.iisd.org\/itn\/2015\/11\/26\/investment-court-system-proposed-by-european-commission\/\">Investment Court System<\/a>\u00a0(<span class='tooltipsall tooltipsincontent classtoolTips72'>ICS<\/span>) composed by a standing tribunal and an appeals mechanism. But the United States is not ready to abandon its\u00a0<a href=\"https:\/\/www.iisd.org\/itn\/2015\/05\/21\/news-in-brief-19\/\">long-standing ISDS model<\/a>\u00a0recently reproduced in the\u00a0<a href=\"https:\/\/www.iisd.org\/itn\/2016\/02\/29\/trans-pacific-partnership-agreement-signed-in-auckland-un-independent-expert-calls-on-states-to-safeguard-regulatory-space\/\">TPP<\/a>.\u00a0<a href=\"http:\/\/hsfnotes.com\/arbitration\/2016\/02\/29\/ttip-12th-round-of-negotiations-concludes-investment-protection-remains-high-on-the-agenda-plus-newly-published-ceta-text-includes-eus-investment-court-system-proposal\/\">Bercero said<\/a>\u00a0the partners are \u201cworking on the basis of textual proposals from both sides\u201d and trying to find convergence.<\/p>\n<p>TTIP faces wide opposition, particularly in Europe. Over 100,000 Dutch citizens have signed a\u00a0<a href=\"https:\/\/ttip-referendum.nl\">petition demanding a referendum<\/a>\u00a0on the agreement. The German Advisory Council on the Environment (SRU), which advises the federal government,\u00a0<a href=\"http:\/\/www.umweltrat.de\/SharedDocs\/Downloads\/DE\/04_Stellungnahmen\/2012_2016\/2016_02_AS19_TTIP.pdf%3F__blob=publicationFile\">indicated<\/a>\u00a0that the agreement could endanger the environment and democracy.
