{"id":3445,"date":"2015-08-04T17:01:19","date_gmt":"2015-08-04T22:01:19","guid":{"rendered":"http:\/\/itn.mattrock.ca\/?p=3445"},"modified":"2024-08-09T18:26:20","modified_gmt":"2024-08-09T16:26:20","slug":"european-commission-requests-member-states-to-terminate-intra-eu-bits","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2015\/08\/04\/european-commission-requests-member-states-to-terminate-intra-eu-bits\/","title":{"rendered":"European Commission requests Member States to terminate intra-EU BITs"},"content":{"rendered":"<p>On June 18, 2015, the\u00a0<a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-15-5198_en.htm\">European Commission initiated infringement proceedings<\/a>\u00a0against Austria, the Netherlands, Romania, Slovakia and Sweden, formally requesting them to terminate their bilateral investment treaties (BITs) with other <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> Member States.<\/p>\n<p>According to the Commission, these treaties are out-dated and no longer necessary, since all Member States are subject to the same rules on cross-border investments, such as freedom of establishment and of capital. It indicates that the rights conferred by intra-EU BITs on a bilateral basis to investors of some Member States constitute nationality-based discrimination and are incompatible with EU law.<\/p>\n<p>The five states have two months to reply to the request. While other infringement proceedings are expected, the Commission is initiating an administrative dialogue on intra-EU <span class='tooltipsall tooltipsincontent classtoolTips63'>BIT<\/span> termination with all other Member States\u2014except for Ireland and Italy, which terminated their own in 2012 and 2013, respectively. A meeting to ensure coordinated termination will be held in October.<\/p>\n<p>In parallel, the Commission plans to discuss improved investment protection within the bloc.
