The interpretation is legally binding on CETA tribunals and was confirmed by the CETA institutional bodies. This demonstrates how states can \u2018modernise\u2019 existing treaties in real time without the political cost of full renegotiation. By issuing a <a href=\"https:\/\/www.international.gc.ca\/trade-commerce\/trade-agreements-accords-commerciaux\/agr-acc\/ceta-aecg\/2026-03-05-statement-declaration.aspx?lang=eng\">binding joint interpretation<\/a>, Canada and the <span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> have created a legal shield for environmental regulation, ensuring it remains a sovereign right rather than a compensable interference with investment.
