{"id":16266,"date":"2025-04-30T14:38:12","date_gmt":"2025-04-30T12:38:12","guid":{"rendered":"https:\/\/www.iisd.org\/itn\/?p=16266"},"modified":"2025-09-04T15:06:19","modified_gmt":"2025-09-04T13:06:19","slug":"ec-infringement-procedure-against-hungary","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2025\/04\/30\/ec-infringement-procedure-against-hungary\/","title":{"rendered":"EC Infringement Procedure against Hungary"},"content":{"rendered":"<p>In March 2025, the European Commission (<span class='tooltipsall tooltipsincontent classtoolTips116'>EC<\/span>) <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/inf_25_503\">sent a reasoned opinion<\/a> to\u202fHungary\u202f\u201cfor undermining the Union&#8217;s position on the international stage with regard to the prohibition of intra-<span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> investor-State arbitrations related to the Energy Charter Treaty (<span class='tooltipsall tooltipsincontent classtoolTips67'>ECT<\/span>).\u201d As we <a href=\"https:\/\/www.iisd.org\/itn\/2024\/10\/09\/european-commission-challenges-hungary-regarding-its-approach-to-intra-eu-arbitrations-under-the-energy-charter-treaty\/\">reported earlier<\/a>, the EC had opened an infringement procedure against Hungary, caused by Hungary\u2019s\u202f<a href=\"https:\/\/cdn.kormany.hu\/uploads\/sheets\/2\/22\/228\/228f2c9ba861fae2b70f183ee4b5ddc.pdf\">declaration<\/a>\u202fregarding the effects of the\u202f<em>Komstroy<\/em>\u202fjudgment of the Court of Justice of the EU (discussed\u202f<a href=\"https:\/\/www.iisd.org\/itn\/en\/2022\/10\/07\/ect-tribunal-upholds-intra-eu-treaty-jurisdictional-objection-for-the-first-time-green-power-v-spain-anqi-wang\/\">here<\/a>) that is, according to the EC, at odds with both the EU position and the judgment.\u202fHungary now has two months to respond and take the requisite measures, failing that, the Commission may initiate a proceedings before the Court of Justice of the EU (<span class='tooltipsall tooltipsincontent classtoolTips42'>CJEU<\/span>).<\/p>\n<script type=\"text\/javascript\"> toolTips('.classtoolTips32','International Institute for Sustainable Development<!--more-->');
