{"id":15896,"date":"2024-10-09T16:22:39","date_gmt":"2024-10-09T14:22:39","guid":{"rendered":"https:\/\/stg.itn.iisd.org\/?p=15896"},"modified":"2025-01-30T14:48:44","modified_gmt":"2025-01-30T13:48:44","slug":"european-commission-challenges-hungary-regarding-its-approach-to-intra-eu-arbitrations-under-the-energy-charter-treaty","status":"publish","type":"post","link":"https:\/\/www.iisd.org\/itn\/2024\/10\/09\/european-commission-challenges-hungary-regarding-its-approach-to-intra-eu-arbitrations-under-the-energy-charter-treaty\/","title":{"rendered":"European Commission challenges Hungary regarding its approach to intra-EU arbitrations under the Energy Charter Treaty"},"content":{"rendered":"<p>According to a <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/inf_24_3228\">press release<\/a>, the European Commission (<span class='tooltipsall tooltipsincontent classtoolTips116'>EC<\/span>) decided to open an infringement procedure against Hungary, \u201cfor undermining the Union&#8217;s position on the international stage with regard to the prohibition of intra-<span class='tooltipsall tooltipsincontent classtoolTips117'>EU<\/span> investor-State arbitrations related to the Energy Charter Treaty (<span class='tooltipsall tooltipsincontent classtoolTips67'>ECT<\/span>), and for contradicting the case law of the Court of Justice of the European Union.\u201d The cause of the procedure lies in Hungary\u2019s <a href=\"https:\/\/cdn.kormany.hu\/uploads\/sheets\/2\/22\/228\/228f2c9ba861fae2b70f183ee4b5ddc.pdf\">declaration<\/a> regarding the effects of the <em>Komstroy<\/em> judgment of the Court of Justice of the EU (discussed <a href=\"https:\/\/www.iisd.org\/itn\/en\/2022\/10\/07\/ect-tribunal-upholds-intra-eu-treaty-jurisdictional-objection-for-the-first-time-green-power-v-spain-anqi-wang\/\">here<\/a>) that is, according to the EC, at odds with both the EU position and the judgment. The EC considers Hungary\u2019s approach to be in violation of multiple provisions of the EU foundational treaties.
