5.3 Investor and Home State Obligations

Investment treaties typically include obligations of the host state to treat investors of the other treaty party or parties in a certain way, making investors the ultimate beneficiaries of the treaty. There has increasingly been debate about whether investors and home states should also carry responsibilities and obligations, including with respect to sustainable development outcomes. This section considers the possibilities for such obligations.
