The increased complexity and importance of international investment agreements has not, to date, been met with the requisite increased capacity of developing countries to negotiate and fully understand these agreements, or to fully appreciate what must be done to comply with them afterwards. This lack of capacity has been formally recognized at the global level on multiple occasions, but this recognition has not been followed with sufficient or critical action.

IISD’s Advisory Services aim to fill this gap, which we consider to be more urgent now than ever. Our services aim to address multiple levels of bilateral and regional negotiations and the rising tide of arbitrations these IIAs have produced.

Please note that IISD does not act for the states involved in an investment dispute, although its legal team is able to assist in managing potential claims, by providing legal opinions and advice.

IISD provides advice for developing countries. However, countries may be requested to contribute towards reasonable expenses. In case of insufficient funds, priority is given to least developed countries.
